The judge of the First Instance Court in Maspalomas, Grand Canary declared our clients contract null and void, ordering the return to the clients approximately 19,000€ plus 3600€ as a sanction for the deposit taken within the prohibited period.
The Spanish timeshare law, based on the EU Directive strictly forbids any payment, even through a third party like a trustee, during the reflection period after signing the contract, which can range from 10 days which can be extended to three months. Though its breach will not necessarily lead to the nullity of the contract, the sanction is to indemnify the clients with double the amount which was paid during this period.
