High Court number 5 of Las Palmas has declared on of our clients contract with ANFI null and void basing  the ruling on a recent Supreme Court sentence from earlier this year applicable for all timeshare resorts in Spain.
The sentence explains that timeshare contracts with floating weeks are illegal, as the object, a main and essential  part of the contract is not determined.
The judgment also studied deeply the prohibition of taking deposits within the first three months of signing the contract, even if it was paid to a trustee. The magistrates maintained their earlier point of view when declaring it unlawful and ordered Anfi to pay it back to our client in double as a way of compensation as per the timeshare law.
Our British clients will be receiving the double of their original purchase price  plus interests, amounting to over 33.000€.
