The judge of the First Instance Court N3 declared our clients contract null and void on the basis that the contract lacked tangibility and a specified “object”. Under the Spanish Timeshare Law of 42/98 a timeshare contract must include certain specific information and must be explained to the consumer in detail prior to signature.
Anfi Resorts have been ordered to return a total of 27,549€ plus an extra 10,487€ worth of maintenance fees and legal interest.
