Once again, Canarian Legal Alliance is very pleased to be able to share with you the testimony of Mrs Heft, a client of ours who have won against ANFI. We would like to thank her not only for her kind words, but her patience and trust placed in us.
“This is how it all begun:
Towards the end of 2012 during one of our holidays on the Spanish island of Gran Canaria, we were fortunate enough to have tuned in to the islands German radio station, mixfm 101 and 104,8 , where we came across CLA´s announcement. The announcement said that many Timeshare owners had been misled and were not properly informed about certain aspects of their contracts. Owners who were potentially affected could then call a number, so naturally I picked up the phone and followed up.
My husband and I had owned timeshare since 1998 and were familiar with the various loose promises made by Timeshare companies. Every holiday we were roped into listening to how the value of our Timeshare was only set to increase and how we should constantly upgrade to better weeks for added value and flexibility. This was all well and good until we reached an age where our kids were grown up and we wanted to downgrade, at which point promises were reneged upon and our weeks became worthless. We tried turning to the second hand resale market only to find out the resale prices are in most cases 80 to 90 % lower than what we paid
Once I made the call to CLA, I found out that their organisation was quite close to our own accommodation so we decided to arrange an appointment and visit their offices. We were informed in detail about everything that was happening in the timeshare world and provided with what I considered to be some good advice. Everything made sense to us.
They then asked us to submit our original contracts, at which point we decided against signing up then.
We flew back to Germany and once back home we met with an attorney, who we personally knew, and proceeded to check whether this Spanish law firm was real and could be trusted. We also tried to verify everything they had told us to the best of our abilities. We were very suspicious and considered back and forth whether we should hand over our contracts to CLA and give the go ahead to begin with the legal process. Ultimately we decided to take the risk and signed up, bringing the documents personally to CLA,s offices in Gran Canaria.
Because this all took place throughout the Spanish summer holidays, the whole process took a very long time. But I have to say that throughout the entire time, we were given great advice by CLA and kept in the loop about what was going on with our case.
At one point we even had to go to court and present our testimony. Throughout this process we were provided with an interpreter who translated for us, given that much of the negotiation was done in Spanish.
After that it was a long waiting game in which we waited for the sentence to be released.
Today I can say that the long wait was worth it. We are pleased to say that we got all our money back, just as promised. Thanks to the support of the entire team at CLA and in particular Jasmine, we never felt alone throughout the process.
The judgement on our case was initially sent to us via email. We received the physical copy of the sentence later in early 2015.
We got the judgment sent to us via email and early in 2015 we had it there in black and white.
WE WON!!!!
Immediately after the court released the money it was transferred to our account.
