Our Norwegian clients´contracts have been declared null and void after the magistrates having seen various infringements of the Spanish Timeshare law in it.
Quoting various rulings from the Supreme Court what our law firm achieved in the past, the judges pointed out the lack of object for the floating weeks, ; the in perpetuity clause in the contracts while by law the duration of a timeshare contract is maximized in 50 years, the illegal deposit taking strictly forbidden by law, even if it was done through a third party (for example trustee), and the lack of information in the contract required, once again, by the law, in order to protect consumers. The serious infringements such as floating weeks or in perpetuity lead to declare the contract radically null and void.
