Congratulations today go to our Swiss clients after claiming victory against Anfi.
The court of the First Instance SBT5 were clear when passing their sentence which nullified our clients contract with Anfi and demanded a repayment of 49.806€ PLUS INTEREST.
In calculating the awarded amount the Judge demanded 36.406€ in respect of the amounts paid on the contract PLUS AN ADDITIONAL 13.400€ in respect of deposits taken illegally within the statutory cooling off period which are repayable in DOUBLE.
Of course we fully expect Anfi to appeal this decision and of course we fully expect that this appeal will fail…….The Judge has passed sentence by applying the laws which have been clearly and unequivocally established by the Supreme Court…….
Until the sentence is confirmed by the High Court then as a matter of standard practice CLA will apply to the court for a provisional execution of these funds. This will force Anfi to deposit these funds with the court thereby securing them for our clients until their delaying tactics come to an end……
