Canarian Legal Alliance would like to congratulate yet another client of ours on the successful outcome of their claim against Anfi.
The judge of the First Instance Court N3 ruled our clients contract be null and void on the basis that it exceeded the allowed length. Under the Spanish Timeshare Law of 42/98 a timeshare contract must be valid for no longer than 50 years.
The selling of floating weeks by Anfi was also condemned by the judge, who stated that a timeshare consumer must be given exact details of the purchase itself. The Supreme Court has ruled on several occasions that due to its lack of tangibility and specificity, the floating system is illegal.
Anfi have also been ordered to return a total of 44,131€ plus legal interest as a form of compensation.
