When we wrote the review of 2015 we said “ we remain confident that 2016 will bring with it even more positive change”. Now, as 2016 draws to a close, this statement looks positively pessimistic. For Canarian Legal Alliance and our clients 2016 was extraordinary.
One year ago we were justifiably proud to have received 3 victories in the Spanish Supreme court. Today that number is 36.
Last year we commented on the way that the Supreme Court guidance has speeded the process in the lower courts. This year we have received decisions in the First Instance court in, literally, hours.
Last year many timeshare resorts were still claiming that the Supreme Court rulings simply did not apply to them. This year we received favourable resolutions not only against Anfi, but Puerto Calma and Palm Oasis.
Now, faced with the knowledge of the inevitable result should their clients pursue court action many of the timeshare companies have gone back to the tried and trusted method of trying to intimidate clients with all sorts of claims about CLA. Our message is clear. We wont be intimidated and neither should you be.
If you have points / floating time, if you have a contract extending beyond 50 years, then you have an illegal contract.
Similarly, if you paid any money within the cooling off period – extended to 3 months in the event that your contract contains any of the above flaws – then your contract, in the view of the Supreme Court, is void and you are entitled to have your money returned to you.
An average of 117,208 euro per month have been awarded to our clients in the last 24 months – a total of 2.81 million euro!
As we look forward to the Christmas break and, perhaps the occasional glass of Sangria, we are firmly fixed on 2017, on further highly significant Supreme Court rulings, on very many more of our clients becoming happy ex-timeshare owners, and to continuing to meet new clients and offering them the hope that comes with the realisation that the law is clear and is on their side.
