We have been receiving many enquiries from members of Silverpoint who have purchased into the “Company Participation Scheme”, regarding emails received from Excel Hotels and Resorts and its Annual General Meeting, which is being held for “participation” holders.
In this email, Excel Hotels & Resorts are including forms to appoint a proxy for those clients who are unable to attend and wish to cast a vote. The problem with these “proxies” are that Excel Hotels & Resorts are urging “clients” to return the signed forms and that they themselves will appoint their own employees to cast the votes on behalf of the “clients”
If any of our existing clients have received this e-mail, please do let us know immediately and do not take any further actions before consulting us.
For those who are not clients of CLA we urge you to seek legal advice not only regarding this general meeting but in general of the product you have purchased from Silverpoint. In earlier occasions, the courts have already declared these contracts to be null and void as they have not guidelines set under the Spanish Timeshare Law of 42/98.
