The judge of the High Court N3 ruled that our clients Silverpoint / Resort Properties contract did not fulfil the requirements needed and declared it null and void.
One of the main illegalities pointed out by the magistrate relates to the selling of “points”. Under the Spanish Timeshare Law of 42/98 a contract must include enough specificity as possible, i.e a specific week, location and date. In her sentence, the judge expressed the lack of tangibility in the point system and condemned Silverpoint / Resorts Properties for the selling of such product.
As well as declaring our clients contract null and void the judge ordered Silverpoint / Resort Properties the return of £30,062 plus legal interest
