The judge of the High Court N4 ruled our clients contract to be null and void on the basis that it included the “point system”. Using the Supreme Court sentences achieved by this firm, the magistrate stated that points cannot be sold to a consumer as they lack tangibility and specificity.
Not only did the judge condemn the selling of points by Club La Costa, but also highlighted the fact that they took monies off the client in the cooling off period. Under the Spanish Timeshare Law of 42/98 a client must be given a certain amount time to decide whether it is an acquisition he or she is really interested in making, and therefore must be put under no pressure to make the purchase.
Our clients will be getting over 28,635€ back as part of their purchase price, plus an extra 19,738€ as a double deposit. On top of this our clients will also receive back their legal fees as well as legal interest.
