Canarian Legal Alliance is happy to announce its latest court success against no other than Anfi Resorts.
The judge of the First Instance N5 has once again cited the recent Supreme Court judgements achieved by Canarian Legal Alliance and declared our client’s contract with Anfi null and void.
Our client had been sold a contract in which two infringements of the Spanish Timeshare Law of 42/98 could be clearly seen by the judge. The first of these was the fact that the contract was sold in perpetuity (unlimited period). Under the law a Timeshare contract must be valid for no longer than 50 years, and this must be clearly indicated on the contract.
In their contract, floating weeks were also included, deemed illegal by the highest-ranking court in Spain for their lack of tangibility and specificity. Just as time has to be specified, so does the location, week and date of said purchased product.
As well as declaring our clients Anfi contract null and void the judge has ordered the return of 39,413€ plus legal interest.
