High Court number 4 of Las Palmas declared our clients contract to be null and void since it contains the “in perpetuity” clause, the illegality of which has been confirmed and reconfirmed on numerous occasions by the Supreme Court in the last few months.
Palm Oasis had argued that their members have bought into a condominium, not timeshare at all, but the judges rejected this argument in applying Timeshare law 42/1998.
Our clients will be receiving over 26,000 euro which represents the purchase price and also recovery of double the amount they had paid as a deposit in compensation for a further infringement of the law in asking for a down payment within the “cooling-off” period.
