What a start to the week, another announcement from the Supreme Court, once again it is against Silverpoint.
In this ruling the court awarded our clients more than 90,000€ which includes the purchase price, double the deposits and maintenance fees. They have also been awarded legal interest and the return of their original legal fees. As this sentence involved many infringements of the timeshare law the contract was also declared null and void.
These infringements as we have seen in other cases involve many aspects, these range from:
- The taking of deposits within the 14 day cooling off period;
- The contract being over 50 years or what is known as “perpetuity”;
- Missing the minimum information required by law.
