The highest-ranking court in Spain has declared itself yet again declaring timeshare contracts signed under perpetuity or containing points / floating weeks illegal. The Spanish Timeshare Law of 42/98 is there to protect consumers and the Supreme Court has shown this by showing no leniency, no matter which resort.
The Supreme Court has also reaffirmed itself on illegal deposit taking. Neither the resort itself or a third party can take a deposit within the first ten days of the contract life-span. This is a period which is given to a consumer to decide whether they wish to keep their timeshare and must be respected.
In these 6 sentences alone, the Supreme Court has ordered a total refund of over 321,274€ with legal fees and legal interest.
