The magistrate of Court n 1 of Maspalomas has confirmed various infringement of the timeshare law in the contract of the litigation process and by declaring it illegal have ordered the timeshare resort to return over 36,000€.
The judge has taken into account that the client had to pay almost all of the purchase price during the reflection period which is strictly forbidden by law, and ordered the infringing company to compensate our clients by paying them back in double the amounts received – just as stipulated by the Spanish 42/98 Law.
The reflection period by law is 10 days which is extendable with three months under special circumstances. During this period the clients shall not pay any payment to the resorts and can withdraw from the agreements without any consequences. The majority of the timeshare contracts what our law firm has seen in the past years fall under the criteria of the special circumstances and had their cancellation period extended to three months, as they were lacking important information required by law.
