The news wouldn’t be the news without the usual avalanche of failed Anfi appeals………
Today High Court No 5 again dismissed another Anfi appeal and again fully supported the previous ruling passed by the court of the First Instance. Our clients contract with Anfi was declared null and void and Anfi were ordered to repay our clients 41.535€ PLUS INTEREST PLUS COSTS.
As those of you who follow us know, Anfi adopts the stalling practice of appealing every First Court victory. In response to their stalling tactic we also adopt our own standard practice of applying to the court for a provisional execution of the awarded funds. Basically we ask the court to go ahead and execute the collection of the funds whilst Anfi are messing around with their appeal process – which we know they will invariably lose……..
In this case, back in March this year after the First Court Victory was achieved, we managed to recover and pay to our clients 31.204€ of the 41.535€ they were awarded. Now the appeal has been won we will proceed to collect the remainder of the awarded amount.
