ANFI APPEAL DISMISSED – SENTENCE CONFIRMED BY HIGH COURT 32.230€

Today we have ANOTHER fantastic High Court victory – This time for our Norwegian clients.

High Court number 5 has AGAIN finalised our clients claim against Anfi by awarding them 32.230€ PLUS INTEREST PLUS COSTS – 10.000€ MORE THAN THEY ORIGINALLY PAID!

Our clients won their claim against Anfi in the courts of the First Instance SBT 5 when the Judge declared our clients’ contract with Anfi null and void and demanded a FULL REPAYMENT OF 14.324€ – the amount paid on the contract.

As expected Anfi appealed this decision but this time WE ALSO APPEALED THE DECISION

In his ruling the Judge from the First Instance Court gave no compensation for the amount taken illegally within the statutory cooling off period. As all our clients and regular readers know the Supreme Court of Madrid ruled that monies taken within this period should be repaid in DOUBLE.

This is not the first time we have experienced this oversight and we were confident that the High Court Judge would rectify the compensation payment.

And that’s exactly what happened- the appeal from Anfi was rejected and our appeal accepted.

In passing sentence, the High Court Judge confirmed the repayment of 14.324€ set by the court of the first instance but ADDED AN ADDITIONAL 17.906€ in respect of deposits taken illegally within the statutory cooling off period taking our clients total awarded amount to 32.230€ PLUS INTEREST PLUS LEGAL FEES.

This is another example of the financial impact the Supreme Court ruling set in relation to deposits taken illegally within the statutory cooling off period has on our clients’ claims. These amounts must be repaid back in DOUBLE which means in this case our clients will be receiving 10.000€ MORE THAN THEY ORIGINALLY PAID – WHAT A FANTASTIC RESULT!!

Following recent events CLA will now proceed to collect these fees through the Mercantile Court.
