ANFI APPEAL DISMISSED SENTENCE CONFIRMED BY HIGH COURT 70.850€

Let’s end ANOTHER successful week for CLA with ANOTHER fantastic High Court victory for our Norwegian clients!

High Court number 3 have AGAIN finalised our clients claim against Anfi by awarding them 70.850€ PLUS INTEREST PLUS COSTS – 30.000€ MORE THAN THEY ORIGINALLY PAID!!! – WHAT A FANTASTIC RESULT!!!

Our clients won their claim against Anfi in the courts of the First Instance SBT 1 when the Judge declared our clients’ contract with Anfi null and void and demanded a repayment of 30.285€ – the amount paid on the contract.

As expected Anfi appealed this decision……but so did CLA……..

In passing the sentence the First Instance Court made no reference to our clients deposit payments. As you all know taking deposits within the statutory cooling off period is ILLEGAL and any amounts taken should be repaid in DOUBLE – a point of law firmly established by the Supreme Court of Madrid.

This is not the first time this has happened – sometimes this point can be overlooked by the first court but in every case where this has happened the mistake has been rectified by the High Court.

And this case was no different……….

The appeal form Anfi was dismissed and our appeal asking for the recognition of illegal deposits was accepted by the High Court.

In passing sentence the Judge from the high court No 3 not only demanded repayment of the 30.285€ in respect of amounts paid on the contracts PLUS AN ADDITIONAL 40.565€€ in respect of the deposits taken illegally within the statutory cooling off period taking our clients total awarded amount to 70.850€ PLUS INTEREST PLUS LEGAL FEES.

Once again, because of the legal precedent set in relation to deposits taken illegally within the statutory cooling off period which states any such amounts should be repaid back in DOUBLE, our clients were awarded 30.000€ MORE THAN THEY ORIGINALLY PAID.

Following recent events CLA will now proceed to collect these fees through the Mercantile Court.
