Today we are pleased to be announcing another victory in the Mercantile Court No1 of Las Palmas.
After declaring our clients contract with Puerto Calma null and void the Judge awarded our clients 28.885€.
As our regular readers know some time ago Puerto Calma filed for liquidation obliging us to take our cases against them to the Mercantile Court in Las Palmas. This court is charged with making decisions for such companies who are (or claim to be) in financial distress.
As in previous rulings The Mercantile Court recognizes that our clients are preferential creditors in the eyes of the company liquidator meaning they will take priority over other debts which the company may have.
Back in November 2019 when we reported our first victory in the Mercantile Court we declared that it was a very significant achievement and would open the door for future claims. It gave assurance to CLA clients that even when a timeshare company goes into liquidation they can still achieve legal redress. This case proves that point again.
