JUDGE CONDEMS THE PERPETUITY CLAUSE AND ORDERS MONIES BE REFUNDED.

Canarian Legal Alliance is delighted to share with you its latest court victory, this time against Chayofa Golf & Tennis Academy.

The judge of the First Instance N3 ruled that our client’s contracts signed under the company United Sales 1997 Ltd included several infringements worthy of nullity. One of the main infringements highlighted by the magistrate was the length of the contract itself. Under the Spanish Timeshare Law of 42/98 perpetuity contracts are illegal as no contract can last longer than the allowed 50-year period.

The taking of a deposit in the “cooling off period” was also condemned by the judge, stating that he/ she who purchases should be given certain time to decide whether it is a purchase he or she wishes to make.

Our clients will also be getting back over £9,732 plus legal interest.
