HIGH COURT DISMISS ANOTHER ANFI APPEAL

High Court No 5 has again dismissed an appeal from Anfi choosing again to fully ratify the ruling passed by the court of the First Instance.

Congratulations to our German client who was awarded 23.520€ plus costs plus legal interest.

Declaring the contract null and void Anfi were condemned to pay our client back the money they paid in full plus double deposits.

The illegality of taking a deposit during the statutory withdrawal period can have a significant effect on a claim. The law states clearly that no deposits should be taken within the statutory period of withdrawal which is 10 days. However, if the statutory period for withdrawal is not correctly and clearly evidenced in the contract or its supporting documentation this 10 days is extended to 3 months. That means that potentially ALL amounts paid in the 3 months following the signing of the contract could be deemed illegal deposits and therefore will be doubled in any compensation claim.

This is exactly what happened in this case. Our client paid 14.000€ in total and will be receiving    23.520€ PLUS costs PLUS legal interest.
