Canarian Legal Alliance is delighted to share with yet another three Supreme Court sentences against no other than Silverpoint (Resort Properties).
The highest-ranking court in Spain has continued confirmed its initial sentences with another three rulings against Silverpoint. In these sentences our client’s contracts have all been declared null and void on the basis that they exceeded the allowed length of 50 years under the Spanish Timeshare Law of 42/98.
The Supreme Court also condemned the illegal deposit taking by Silverpoint, reaffirming article 11 in the Spanish Timeshare Law of 42/98, which states that a consumer must be given a 10 day period in which no monies can be taken of them. Should this happen, consumers are entitled to claim back these amounts in double.
Our clients will be getting back a total of 134,434€ plus legal fees and legal interests.
