Third Supreme Court Sentence Says Timeshare Deposits are Illegal

Mic_Anfi-Supr_only-fallo-(1)-1Once again this ruling involved Anfi del Mar, this time addressing the issue of deposits taken by the Timeshare resorts within a three month period after a contract has been signed. In its ruling, the Highest Ranking Court in Spain explained that any deposit payments, even if when paid to a third party or trustee are to be considered illegal.

This particular issue marks the end of a longstanding battle between the courts and Timeshare resorts, with the trustee system being characterised by magistrates as making a mockery of the law, and simply a method to circumvent buyer protection legislation.

This act by the Supreme Court creates yet another precedent that is surely set to help thousands of miss sold timeshare consumers who paid money for their Timeshare within the mandatory cooling off period.

We welcome the courts decision and look forward to the industry change that it will bring.
