Here we are again, it’s the end of yet another fantastic year for Canarian Legal Alliance and the clients it represents. 2017 was an outstanding year for all who were seeking justice, and in 2018 not only have we continued this, but we have surpassed it!
By the end of the year we have reached the record-breaking number of 130 favourable Supreme Court rulings and have continued to set precedents as it pertains to different timeshare disputes. Just a few days ago we received our first Supreme Court sentence against Diamond Resorts, confirming what the lower courts have already ruled in many occasions: contracts that do not fulfill the timeshare law, shall be declared null and void.
But this is not the only record we have set. Canarian Legal Alliance has received 338 favourable rulings throughout different courts in Spain, (that is more than one a day, and more than double of those achieved in 2017!), with more than 12.5 million Euros rewarded to our clients. One of the most recent successes Canarian Legal Alliance can claim is the ability to obtain nullity of those contracts signed with Silverpoint where clients were on paper buying a company participation, just to avoid the application of the timeshare law. However not only have the courts seen through this tactic, but even Silverpoint have recognised to the courts their wrongdoings.
Companies who were found in wrongdoing are for example: Anfi, Puerto Calma / Holiday Club, Diamond, Club La Costa, Airtours, Palm Oasis, Regency Club etc.
However, these incredible numbers do not come without the very hard work and dedication shown by our legal team, who presented in 2018 more than 500 writs, and have assisted over 670 hearing at the courts of Spain.
Currently we are representing over 1380 clients at different stages of their respective cases, and all together more than 3600 families have entrusted Canarian Legal Alliance to take actions regarding their mis sold timeshares.
Our ever-expanding law firm is now represented in the United Kingdom, Germany, Denmark, Sweden, Norway, Finland and has also maintained its various offices located in Gran Canaria and Malaga
By the end of the year we have now paid out over 2.3 million €, with a record payout from Silverpoint for over 100.000€. But there is more! We now have a special department within our legal team whose primary function is to take care of enforcements and this year alone have been able to get more than 700.000€ in bank guarantees, meaning while there is provisional sentence and not a definite resolution, our clients will have peace of mind that their monies as safe in the form of bank guarantees.
Another important advance we have experienced this year is the fact that many judges now decide at the preliminary hearing to pass a resolution without the need of a trial. What this does is make cases faster and more comfortable for our clients. We hope that this practice will be adopted by all courts and become more and more common.
